Privacy Policy

1) Introduction and Contact Details of the Controller

1.1 We are pleased that you are visiting our website and thank you for your interest. Below, we inform you about the handling of your personal data when using our website. Personal data means any data by which you can be personally identified.

1.2 The controller responsible for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is Jean-Luca Karsten, Martin-Luther-King-Allee 37, 18147 Rostock, Germany, Tel.: 017645681201, Email: wxkemeup@wxkemeup.com. The controller responsible for the processing of personal data is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data.

2) Data Collection When Visiting Our Website

2.1 When using our website for purely informational purposes, i.e. if you do not register or otherwise provide us with information, we only collect data that your browser transmits to the page server (so-called "server log files"). When you access our website, we collect the following data, which is technically necessary for us to display the website to you:

The website visited

Date and time of access

Amount of data sent in bytes

Source/referrer from which you accessed the page

Browser used

Operating system used

IP address used (if applicable, in anonymized form)

The processing is carried out in accordance with Art. 6(1)(f) GDPR on the basis of our legitimate interest in improving the stability and functionality of our website. The data will not be disclosed or otherwise used. However, we reserve the right to subsequently review the server log files if there are specific indications of unlawful use.

2.2 For security reasons and to protect the transmission of personal data and other confidential content (e.g. orders or inquiries to the controller), this website uses SSL or TLS encryption. You can recognize an encrypted connection by the character string "https://" and the padlock symbol in your browser's address bar.

3) Hosting & Content Delivery Network

For hosting our website and displaying its content, we use a provider that provides its services itself or through selected subcontractors exclusively on servers located within the European Union.

All data collected on our website is processed on these servers unless different recipients of specific data processing are specified below.

We have concluded a data processing agreement with the provider, which ensures the protection of our website visitors' data and prohibits unauthorized disclosure to third parties.

4) Cookies

In order to make visiting our website attractive and to enable the use of certain functions, we use cookies, i.e. small text files that are stored on your device. Some of these cookies are automatically deleted after you close your browser (so-called "session cookies"), while others remain on your device for a longer period of time and enable the storage of page settings (so-called "persistent cookies"). In the latter case, you can find information about the storage period in the overview of your web browser's cookie settings.

If personal data is also processed by individual cookies used by us, the processing is carried out in accordance with Art. 6(1)(b) GDPR either for the performance of a contract, in accordance with Art. 6(1)(a) GDPR in the event of consent having been given, or in accordance with Art. 6(1)(f) GDPR to safeguard our legitimate interests in the best possible functionality of the website and a customer-friendly and effective design of the website visit.

You can configure your browser so that you are informed about the setting of cookies and can decide individually whether to accept them, or exclude the acceptance of cookies in certain cases or generally.

Please note that if you do not accept cookies, the functionality of the website may be restricted.

5) Contacting Us

When contacting us (e.g. via contact form or email), personal data is collected. Which data is collected when using a contact form can be seen from the respective contact form. This data is used and stored exclusively for the purpose of responding to your inquiry or for contacting you and the associated technical administration.

The legal basis for processing this data is our legitimate interest in responding to your inquiry in accordance with Art. 6(1)(f) GDPR. If your contact is aimed at concluding a contract, an additional legal basis for processing is Art. 6(1)(b) GDPR. Your data will be deleted after your inquiry has been conclusively processed. This is the case if it can be inferred from the circumstances that the matter in question has been conclusively clarified and provided that there are no statutory retention obligations to the contrary.

6) Data Processing for Order Processing

To the extent necessary for the processing of a contract for delivery and payment purposes, the personal data collected by us will be passed on to the commissioned transport company and the commissioned credit institution in accordance with Art. 6(1)(b) GDPR.

If, on the basis of a corresponding contract, we owe you updates for goods with digital elements or for digital products, we process the contact details you provided when placing the order in order to inform you personally as part of our statutory information obligations in accordance with Art. 6(1)(c) GDPR. Your contact details will be used strictly for the purpose of communicating information about updates owed by us and will only be processed by us to the extent necessary for the respective information.

7) Web Analytics Services

IONOS WebAnalytics

This website uses the web analytics service provided by the following provider: IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany.

With the help of cookies and/or comparable technologies (tracking pixels, web beacons, algorithms for reading device and browser information), the service collects and stores pseudonymized visitor data, including information about the device used, such as the IP address and browser information, in order to evaluate this data for statistical analysis of user behavior on our website and to create pseudonymized usage profiles. Among other things, this enables the analysis of movement patterns (so-called heatmaps), which show the duration of page visits and interactions with page content (e.g. text input, scrolling, clicks and mouse-overs). Pseudonymization generally prevents direct identification of individuals. The data is not combined with other clear-text data collected about you in any other way.

All processing described above, in particular the reading or storage of information on the device used, is only carried out if you have expressly consented to this in accordance with Art. 6(1)(a) GDPR. You can withdraw your consent at any time with effect for the future by deactivating this service in the "Cookie Consent Tool" provided on the website.

We have concluded a data processing agreement with the provider, which ensures the protection of our website visitors' data and prohibits unauthorized disclosure to third parties.

8) Website Functionalities

Spotify

This website integrates functionalities of the following music service provider for playing music tracks: Spotify AB, Birger Jarlsgatan 61, 113 56 Stockholm, Sweden.

When visiting this page, the integration may establish a direct connection between your browser and the provider's servers, even if you do not have an account with the provider or are not logged into one.

As a result, the provider receives information that you have visited our website. The information collected (which may include your IP address) is transmitted directly from your browser to a server operated by the provider and stored there. However, the information is not used to personally identify you and is not passed on to third parties.

If you play a music track using the corresponding functionality while logged into a user account with the provider, the provider may associate your visit to our website with that account. If you do not want such an association with your account, you must log out before activating the playback button.

The data processing described above is carried out in accordance with Art. 6(1)(f) GDPR on the basis of our legitimate interest in providing an appealing audio design for the visit to our website.

You can also object to the loading of the provider's playback functions and thus to the data processing described above for the future by using browser add-ons, e.g. the script blocker "NoScript" (https://noscript.net/).

9) Tools and Other Services

Cookie Consent Tool

This website uses a so-called "Cookie Consent Tool" to obtain valid user consent for cookies and cookie-based applications that require consent. The "Cookie Consent Tool" is displayed to users when they access the website in the form of an interactive user interface, where consent can be given for certain cookies and/or cookie-based applications by selecting the corresponding checkboxes. The tool ensures that cookies/services requiring consent are only loaded if the respective user has given consent by selecting the corresponding checkbox. This ensures that such cookies are only placed on the user's device if consent has been given.

The tool uses technically necessary cookies to store your cookie preferences. Personal user data is generally not processed in this context.

If, in individual cases, personal data is processed for the purpose of storing, assigning or logging cookie settings (such as the IP address), this processing is carried out in accordance with Art. 6(1)(f) GDPR on the basis of our legitimate interest in legally compliant, user-specific and user-friendly cookie consent management and therefore in the legally compliant design of our website.

Another legal basis for processing is Art. 6(1)(c) GDPR. As controllers, we are subject to a legal obligation to make the use of technically unnecessary cookies dependent on the respective user's consent.

Where necessary, we have concluded a data processing agreement with the provider, which ensures the protection of our website visitors' data and prohibits unauthorized disclosure to third parties.

Further information about the operator and the available settings of the Cookie Consent Tool can be found directly in the corresponding user interface on our website.

10) Rights of Data Subjects

Right to rectification pursuant to Art. 16 GDPR;

Right to erasure pursuant to Art. 17 GDPR;

IF WE PROCESS YOUR PERSONAL DATA ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST AS PART OF A BALANCING OF INTERESTS, YOU HAVE THE RIGHT TO OBJECT TO THIS PROCESSING AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION, WITH EFFECT FOR THE FUTURE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE PERSONAL DATA CONCERNED. HOWEVER, FURTHER PROCESSING REMAINS RESERVED IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FREEDOMS, OR IF THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENSE OF LEGAL CLAIMS.

IF WE PROCESS YOUR PERSONAL DATA FOR THE PURPOSE OF DIRECT ADVERTISING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING. YOU MAY EXERCISE YOUR RIGHT TO OBJECT AS DESCRIBED ABOVE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE PERSONAL DATA CONCERNED FOR DIRECT ADVERTISING PURPOSES.

11) Duration of Storage of Personal Data

The duration for which personal data is stored is determined on the basis of the respective legal basis, the purpose of the processing and, where applicable, additionally on the basis of the respective statutory retention period (e.g. commercial and tax law retention periods).

When personal data is processed on the basis of express consent pursuant to Art. 6(1)(a) GDPR, the data concerned will be stored until you withdraw your consent.

If statutory retention periods exist for data processed in the context of legal transactions or legal obligations similar to legal transactions on the basis of Art. 6(1)(b) GDPR, this data will be routinely deleted after the expiry of the retention periods, provided that it is no longer required for contract fulfillment or contract initiation and/or we have no legitimate interest in continuing to store it.

When personal data is processed on the basis of Art. 6(1)(f) GDPR, this data will be stored until you exercise your right to object pursuant to Art. 21(1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims.

When personal data is processed for the purpose of direct advertising on the basis of Art. 6(1)(f) GDPR, this data will be stored until you exercise your right to object pursuant to Art. 21(2) GDPR.

Unless otherwise stated in the other information contained in this privacy policy regarding specific processing situations, stored personal data will otherwise be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
